Eminent Domain

Perhaps the most significant property rights bill offered during the 2007-08 session of the North Carolina General Assembly was House Republican Leader Paul "Skip" Stam's attempt to allow North Carolina voters to decide by referendum whether to enact a constitutional amendment prohibiting the taking of private property by eminent domain for economic development or revenue enhancement purposes. The bill also sets out remedies for private property owners.
